IMPORTANT MEDICAL DISCLAIMER: The OxyZen device is a wellness and fitness product designed for general health monitoring. It is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition.
2.1 Not a Substitute for Medical Care
- OxyZen is not a substitute for professional medical advice, diagnosis, or treatment
- Always consult a qualified healthcare provider for medical concerns
- Do not use OxyZen data to make medical decisions without consulting a doctor
- Never disregard professional medical advice based on information from OxyZen
- If you experience a medical emergency, call emergency services immediately

- Factors such as device placement, movement, and skin condition can affect accuracy
- OxyZen should not be used as the sole basis for health-related decisions

- Skin tone, tattoos, and circulation can affect sensor performance
- The device is not designed for use in neonatal, pediatric, or life-support situations
3. User Eligibility and Accounts
3.1 Age Requirement
You must be at least 18 years old to purchase and use OxyZen. By using our services, you represent that you meet this age requirement.
3.2 Account Registration
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities under your account
- Notify us immediately of any unauthorized access or security breach
- We reserve the right to suspend or terminate accounts that violate these Terms

7. Limited Warranty
7.1 One-Year Limited Warranty
OxyZen warrants that the device will be free from defects in materials and workmanship for one (1) year from the date of purchase when used under normal conditions.

- Hardware malfunctions under normal use
7.3 Warranty Exclusions
This warranty does NOT cover:
- Normal wear and tear
- Damage from misuse, abuse, or accident

- Water damage (unless device is rated as water-resistant and damage occurs within specifications)
- Lost or stolen devices
- Cosmetic damage that doesn't affect functionality
- Damage from use of third-party accessories
- Software issues (covered separately)
7.4 Warranty Claims
To make a warranty claim:
- Contact us at hello@oxyzen.ai with proof of purchase
- Describe the defect and provide photos if requested
- We will determine if the issue is covered under warranty
- If approved, we will repair or replace the device at our discretion
7.5 DISCLAIMER OF WARRANTIES
EXCEPT AS EXPRESSLY PROVIDED IN THIS LIMITED WARRANTY, OXYZEN PROVIDES THE DEVICE AND SERVICES "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- OxyZen shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- This includes damages for loss of profits, data, health outcomes, or other intangible losses
- Our total liability shall not exceed the amount you paid for the OxyZen device
- These limitations apply even if we have been advised of the possibility of such damages
- Some jurisdictions do not allow limitation of liability for personal injury, so this may not apply to you
8.1 Health and Medical Disclaimer
OxyZen is not liable for:
- Medical decisions made based on device data
- Failure to detect or warn of health conditions
- Inaccurate readings or measurements
- Health outcomes resulting from device use or non-use
- Delays in seeking medical care due to reliance on device data
9. Intellectual Property Rights

- The OxyZen brand, logos, and trademarks

- Mobile application software and updates

- All copyrights, patents, and trade secrets

- Upon termination, your license to use our services ends immediately

15. Indemnification
You agree to indemnify, defend, and hold harmless OxyZen Medical Technology LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

- Your violation of any third-party rights

16. Dispute Resolution
16.1 Informal Resolution
Before filing a claim, you agree to contact us at hello@oxyzen.ai to attempt to resolve the dispute informally for at least 30 days.
16.2 Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY - IT AFFECTS YOUR LEGAL RIGHTS
Any dispute arising from these Terms or your use of OxyZen shall be resolved through binding arbitration, except:
- Small claims court actions (if eligible)
- Intellectual property disputes
- Claims for injunctive relief
Arbitration Terms:
- Arbitration will be conducted by the American Arbitration Association (AAA)
- Proceedings will be governed by AAA Consumer Arbitration Rules
- Arbitration will take place in Pennsylvania or your home state
- The arbitrator's decision is final and binding
- You waive the right to a jury trial
16.3 Class Action Waiver
YOU AGREE THAT DISPUTES MUST BE BROUGHT INDIVIDUALLY AND NOT AS PART OF A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. You waive the right to participate in a class action lawsuit or class-wide arbitration.
16.4 Opt-Out of Arbitration
You may opt out of this arbitration agreement by sending written notice to hello@oxyzen.ai within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
17. Governing Law and Jurisdiction
- These Terms are governed by the laws of the Commonwealth of Pennsylvania and federal U.S. law
- Excluding its conflict of law provisions
- Exclusive jurisdiction for non-arbitrated disputes shall be in the state and federal courts located in Pennsylvania
18. Miscellaneous Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and other referenced policies, constitute the entire agreement between you and OxyZen.
18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18.3 Waiver
Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
18.4 Assignment
You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.
18.5 Force Majeure
We are not liable for failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or government actions.
18.6 Export Controls
You agree to comply with all applicable export and import laws and regulations. You may not export or re-export OxyZen to prohibited countries or individuals.
18.7 Language
These Terms are provided in English. Any translations are for convenience only. In case of conflict, the English version prevails.
